Summary: Rwanda

The Mining Law of Rwanda, adopted by the Law n° 58/2018 of 13/08/2018, regulates mining and quarry operations within the territory of Rwanda. The law is available on the official government website (http://www.minirena.gov.rw/). The official version of this law is in English, French and Kinyarwanda. There are no official translations of this law into other additional languages. The government regulating entity is the Ministry of Natural Resources (MINIRENA). The country's mining contracts are not available at resourcecontracts.org.

The Chamber of Deputies, in its session of 11 February 2015;

Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003 as amended to date, especially in articles 29, 62, 66, 67, 90, 92, 93, 108 and 201;

Pursuant to the Convention on the Settlement of Investment Disputes between States and Nationals of Other States adopted in Washington on 18 March 1965 as ratified by Law n° 01/82 of 26 January 1982;


Pursuant to the Treaty Establishing the Common Market for Eastern and Southern Africa (COMESA) adopted in Kampala, Uganda on 5 November 1993 as ratified by the Presidential Order n° 004/94 of 1/12/1994;

Pursuant to the Treaty of Accession of the Republic of Rwanda to the East African Community, signed in Kampala, Uganda on 18 June 2007 as ratified by the Presidential Order n° 24/01 of 28/06/2007;

Having reviewed Law n° 26/2005 of 17/12/2005 relating to investment and export promotion and facilitation;

This law governs labour relations between workers and employers as well as between the latter and the apprentices or the trainees under their authority as per contract.

This organic law is particularly concerned with the following :

1° classified installations as stated in their nomenclature;

2° factories, warehouses, mines, building sites, quarries, underground or above the ground stock pilings;

3° shops and workshops;

4° installations used or which are in responsibility of any natural or legal person or private association, public institution which may cause a danger or accidents either on a commodity, health, as well as security;

5° dumping, discharging and storing substances that may provoke or increase the degradation of the area of placement;

6° substances, chemical products, a combination of manufactured or natural substances may, depending on their hazardous nature, be dangerous to human health, soil conservation and sub soils, water, flora and fauna, environment in general when they are used or dumped in the natural surroundings.

This Law establishes a tax on minerals

This Law determines modalities for protecting, conserving and promoting the environment in Rwanda.

This Law determines modalities of allocating, acquisition, transfer, use and management of land in Rwanda.

It also establishes the principles applicable to rights recognised over all lands situated on Rwanda’s national territory and all rights united or incorporated with land, whether naturally or artificially.
